THEWOKELY Privacy Policy

Last updated: 25 July 2026

1. About this Privacy Policy

TheWokely operates an independent news, analysis and commentary website based in Western Australia.

In this Privacy Policy, “TheWokely”, “we”, “us” and “our” refer to the operator of TheWokely.

This policy explains how we collect, hold, use, disclose and protect personal information when you:

  • Visit TheWokely;
  • Subscribe to our newsletter;
  • Contact or correspond with us;
  • Submit feedback, an enquiry or other material;
  • Interact with our emails;
  • Comment on content, where commenting is available; or
  • Otherwise use our website or services.

We aim to handle personal information responsibly and consistently with the Privacy Act 1988 (Cth) and the Australian Privacy Principles to the extent that they apply to us. Where those laws do not apply, we may still follow similar principles as a matter of good privacy practice.

2. What is personal information?

Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable.

Depending on how you interact with TheWokely, this may include your name, email address, correspondence, subscription details, internet protocol address and information about your interactions with our website or emails.

3. Information we may collect

Information you provide directly

We may collect information you voluntarily provide, including:

  • Your first name or preferred name;
  • Your email address;
  • Your newsletter preferences;
  • Information entered into a contact form;
  • Messages, enquiries, feedback or complaints;
  • Information submitted when reporting an editorial or technical issue;
  • Material you submit for consideration or publication; and
  • Any other information you choose to include in correspondence with us.

You may browse most parts of TheWokely without providing your name or contact details.

Newsletter subscription information

When you subscribe to our newsletter, we may collect:

  • Your email address;
  • Your first name, where voluntarily provided;
  • The date and method of subscription;
  • Your confirmation and subscription status;
  • Records showing when and how consent was provided;
  • Delivery, failure and bounce information;
  • Whether an email or link was opened or selected;
  • Subscription preferences; and
  • Unsubscription requests.

Providing a first name is optional unless a subscription form clearly states otherwise. An email address is necessary for us to deliver newsletters.

Contact and correspondence information

When you contact TheWokely, we may collect:

  • Your name;
  • Your email address;
  • The subject and contents of your message;
  • Attachments you voluntarily provide;
  • Relevant previous correspondence;
  • The date and time of the communication; and
  • Technical information used to identify spam, abuse or malicious activity.

Please do not provide passwords, payment-card information, identity documents or highly sensitive information through an ordinary contact form or email.

Our general contact channels are not intended to operate as secure whistleblower, legal-confidentiality or encrypted tip-submission services.

Information collected automatically

When you access TheWokely, our website and service providers may automatically collect technical and usage information such as:

  • Your internet protocol address;
  • Browser and device type;
  • Operating system;
  • Screen or device characteristics;
  • Approximate geographic region;
  • Referring website or search engine;
  • Pages and articles visited;
  • Date, time and approximate duration of visits;
  • Links selected;
  • Cookie or device identifiers;
  • Website errors;
  • Email delivery and interaction events; and
  • Security, access and server-log information.

Some technical information may not identify you by itself but may become personal information when combined with other available information.

Comments and public contributions

Where commenting or public-contribution features are available, we may collect the information you submit, together with your display name, email address, submission time and relevant anti-spam information.

Information submitted for public display may be visible to other readers and may be indexed by search engines. You should not include information in a public comment that you do not wish to make publicly available.

Sensitive information

TheWokely does not ordinarily seek to collect sensitive information.

Because our content may concern politics, religion, health, identity, discrimination and other social issues, information voluntarily provided in correspondence could reveal sensitive information such as political opinions, religious beliefs, health information or personal experiences.

Where you voluntarily provide sensitive information, we will use it only for the reason it was provided, with your consent, or where otherwise authorised or required by law.

Reading or subscribing to particular content does not necessarily indicate that you agree with it or hold any particular political, religious or personal belief. We do not intentionally use reading history to infer sensitive personal attributes.

4. How we collect information

We may collect personal information:

  • Directly from you through a subscription, contact or submission form;
  • When you email or otherwise communicate with us;
  • When you comment or submit material for publication;
  • Automatically through cookies, analytics, security tools and server logs;
  • Through newsletter delivery and engagement systems;
  • Through spam-prevention and website-security services; and
  • From service providers performing functions on our behalf.

We do not purchase third-party mailing lists or add people to our newsletter merely because they contacted us about an unrelated matter.

5. Why we collect and use information

We may collect, hold and use personal information to:

  • Operate and maintain TheWokely;
  • Deliver website content and requested services;
  • Manage newsletter subscriptions;
  • Send newsletters and publication updates you requested;
  • Confirm subscription requests;
  • Respond to questions, messages, complaints and feedback;
  • Review material submitted for possible publication;
  • Understand general readership and website usage;
  • Improve TheWokely’s journalism, commentary, website and communications;
  • Diagnose and correct technical problems;
  • Monitor newsletter delivery and performance;
  • Prevent spam, fraud, misuse and malicious activity;
  • Protect the security of the website and associated systems;
  • Maintain administrative and business records;
  • Establish, exercise or defend legal rights;
  • Comply with legal obligations;
  • Respond to lawful requests from courts, regulators or authorities; and
  • Produce aggregated or appropriately de-identified statistics.

We will not use personal information for an unrelated purpose unless you have consented or the use is otherwise permitted or required by law.

6. Newsletters and direct marketing

We will ordinarily send newsletters or promotional communications only where:

  • You have subscribed;
  • You have otherwise provided consent; or
  • The communication is otherwise permitted by applicable law.

We may require you to confirm your email address before activating your subscription.

We may use trusted newsletter-management and email-delivery providers to manage subscriptions and send communications on our behalf.

Each marketing newsletter will include a clear method of unsubscribing. You may also ask to be removed by contacting us directly.

We will process valid unsubscribe requests as soon as reasonably practicable and, where the Spam Act 2003 (Cth) applies, within the legally required period.

After you unsubscribe, we may retain a limited suppression record containing your email address and opt-out status. This allows us to honour your request and avoid inadvertently adding the address back to the mailing list.

We do not sell, rent or trade our subscriber list.

7. Cookies and similar technologies

TheWokely may use cookies, local storage, tags, pixels and similar technologies.

These technologies may be used for:

  • Essential website functions;
  • Remembering preferences;
  • Website security;
  • Spam and abuse prevention;
  • Measuring website traffic;
  • Understanding which content is useful to readers;
  • Diagnosing errors;
  • Managing sessions; and
  • Measuring email delivery and interaction.

Some cookies are necessary for the website to operate. Other cookies may be used for analytics or performance measurement.

You can usually control or delete cookies through your browser settings. Blocking some cookies may prevent parts of the website from functioning correctly.

Where required by applicable law, we may ask for consent before activating particular non-essential technologies.

8. Website analytics

We may use website analytics services to understand how readers use TheWokely.

Depending on their configuration, these services may collect or receive:

  • Device and browser information;
  • Pages and articles visited;
  • Referral sources;
  • Approximate geographic region;
  • Interaction events;
  • Cookie or device identifiers; and
  • Internet protocol information.

We use this information to understand general readership patterns, diagnose technical problems, improve website performance and make editorial or operational decisions.

We do not intentionally provide passwords, message contents or sensitive information to analytics services.

Analytics information may be aggregated or de-identified where reasonably practical.

9. Contact forms and editorial submissions

Information submitted through a contact form or email may be used to:

  • Respond to your enquiry;
  • Review feedback or complaints;
  • Investigate an editorial or technical issue;
  • Assess material offered for possible publication;
  • Prevent spam or malicious activity; and
  • Maintain an appropriate record of the communication.

Submitting material does not guarantee that it will be published or that TheWokely will enter into further correspondence.

Unless we expressly agree otherwise, sending information to TheWokely does not create a confidential, legal, professional, employment or contractual relationship.

We will not ordinarily publish your private contact details without your permission unless publication is authorised or required by law.

10. Embedded content and external websites

TheWokely may contain links to, or embedded content from, external websites. This may include videos, images, social-media content, documents, news sources and public-sector websites.

Embedded content may behave as though you visited the external website directly. The external operator may collect information, use cookies or monitor your interaction in accordance with its own privacy practices.

TheWokely does not control the privacy, security or information-handling practices of external websites. You should review the relevant external privacy policy before providing personal information.

11. Disclosure of personal information

We may disclose personal information to trusted organisations that assist us in operating TheWokely, including:

  • Website and email-hosting providers;
  • Newsletter-management and email-delivery providers;
  • Analytics and website-performance providers;
  • Form-processing and spam-prevention providers;
  • Backup, storage and security providers;
  • Website developers and technical-support providers;
  • Professional advisers such as lawyers and accountants;
  • Government authorities, regulators, courts or law-enforcement bodies where disclosure is authorised or required by law;
  • A purchaser, successor or adviser involved in a genuine sale, transfer or restructuring of TheWokely; and
  • Another party where you have consented to the disclosure.

Service providers may access information only to the extent reasonably necessary to provide their services, protect their systems or meet legal obligations.

At the date of this policy, we do not sell personal information to data brokers or unrelated advertisers.

12. Overseas processing and disclosure

Some organisations that provide hosting, email, analytics, security, storage or other technology services operate internationally.

Personal information may therefore be stored in, accessed from or processed outside Australia, potentially including in:

  • The United States;
  • Countries within the European Economic Area; and
  • Other countries in which our service providers or their infrastructure operate.

The privacy and data-protection laws of other countries may differ from Australian law.

Where reasonably practical, we take steps to select reputable providers and limit the information made available to them. The exact location of processing may change as providers alter their infrastructure.

13. Storage and security

Personal information may be held:

  • In website databases;
  • On hosting infrastructure;
  • In email accounts;
  • In newsletter and communications systems;
  • In security and access logs;
  • In service-provider systems; and
  • In protected backups.

We take reasonable administrative, technical and organisational steps to protect information against:

  • Loss;
  • Misuse;
  • Interference;
  • Unauthorised access;
  • Unauthorised modification; and
  • Unauthorised disclosure.

These measures may include access restrictions, account security, encryption in transit, software maintenance, backups, spam prevention and security monitoring.

We do not publish detailed information about our security architecture, configurations or controls because doing so could undermine their effectiveness.

No website, database, email system or internet transmission can be guaranteed to be completely secure.

14. Retention and deletion

We retain personal information only for as long as reasonably necessary for the purposes described in this policy, including to:

  • Provide requested services;
  • Maintain subscriptions;
  • Keep consent and suppression records;
  • Respond to enquiries and complaints;
  • Maintain security and administrative records;
  • Meet legal, accounting or reporting obligations; and
  • Establish, exercise or defend legal rights.

When information is no longer reasonably required, we may delete it or de-identify it, subject to legal requirements, technical limitations and ordinary backup-retention processes.

Unsubscribing stops future newsletter marketing but may not immediately remove information from backups, delivery records, security logs or suppression lists.

15. Accessing or correcting your information

You may contact us to request:

  • Access to personal information we hold about you;
  • Correction of inaccurate or outdated information;
  • Removal from our newsletter;
  • Deletion of information where appropriate; or
  • Further information about how your information has been handled.

We may ask you to verify your identity before providing access or making changes. This helps prevent personal information from being disclosed or altered improperly.

We may refuse or limit a request where authorised by law, where fulfilling it would unreasonably affect another person’s privacy, or where the information must be retained for legitimate legal or security reasons.

Where appropriate, we will explain why a request has been refused or limited.

16. Anonymity and pseudonyms

You may browse most of TheWokely without identifying yourself.

You may also use a preferred name or pseudonym when contacting us where it is lawful and practical to do so. However, we may need an accurate email address to reply, manage a subscription or verify a request involving personal information.

17. Children’s privacy

TheWokely is a general news and commentary website and is not specifically designed to collect personal information from children.

We do not knowingly seek personal information from children without appropriate involvement from a parent or guardian.

A parent or guardian who believes that a child has provided personal information inappropriately may contact us to request its review or removal.

18. Data breaches

A data breach may occur when personal information is lost, accessed without authorisation or disclosed without authorisation.

If we become aware of a suspected breach, we will take reasonable steps to investigate, contain and address it.

Where TheWokely is covered by the Privacy Act and a breach is likely to cause serious harm, the Notifiable Data Breaches scheme may require notification to affected individuals and the Office of the Australian Information Commissioner.

19. Privacy questions and complaints

You may submit a privacy question or complaint by emailing:

huxherbert.thewokely@gmail.com

Please include sufficient information for us to understand your concern, such as:

  • Your name and preferred contact details;
  • A description of the issue;
  • Relevant dates or communications; and
  • The outcome you are seeking.

We will investigate privacy complaints fairly and respond within a reasonable period.

Where the Privacy Act applies and you remain dissatisfied with our response, you may be entitled to make a complaint to the Office of the Australian Information Commissioner.

20. Changes to this policy

We may update this Privacy Policy when:

  • TheWokely’s website or services change;
  • Our information-handling practices change;
  • We introduce or remove service providers;
  • Applicable laws or regulatory guidance change; or
  • New privacy or security risks are identified.

The current version will be published on this page with its latest revision date.

Material changes may also be communicated through the website or newsletter where appropriate.
